Terms and Conditions
By purchasing surveys and services from FACITanalysis, you (the “Customer”) also accept our terms and conditions described below.
1. General provisions
1.1 Product and services
FACITanalysis offers design and execution of online customer and employee satisfaction surveys. Our survey solution is based on proven survey templates, where it is possible to customize the question text if needed.
FACITanalysis reserves the right to reject questions. For example, we do not convey questions that have a discriminatory, discouraging or judgmental content.
1.2 Change of business terms
FACITanalysis is at any time entitled to change the terms of business with one month’s notice. When purchasing surveys, the terms of business applicable at the time of purchase apply. It is the Customer’s responsibility at all times to keep up to date with the applicable terms and conditions on FACITanalysis’s website.
2. Rights
2.1 Right of use
The Customer alone owns the survey result defined by the results report that completes the survey process.
2.2 Data collection
FACITanalysis uses ZOHO SURVEY when we execute surveys. Contact and survey data are stored at ZOHO SURVEY for as long as a survey is active. Read more about Privacy Policy and GDPR at ZOHO SURVEY. Google Sheets and Google Data Studio (Looker Studio) are used when designing results reports.
2.3 Customer and personal information
Customer and personal information is all kinds of information that to some extent can be attributed to the Customer. Customer and personal information is never given to third parties unless written consent has been given. Customer and personal information is used to complete the purchase or service in connection with which the information is collected. The information can also be used for analysis aimed at optimizing our services and content. FACITanalysis can on its website refer to the company name of the Customer when a survey is executed by us on behalf of the Customer (unless the Customer has objected to this in writing).
2.4 Update
In the event of an update of software or equipment, FACITanalysis has the right to block access to surveys for a limited period, which will typically be when as few customers as possible will be affected by it. Such closure does not entitle the Customer to compensation.
3. Prices and payment terms
3.1 Price and VAT
FACITanalysis reserves the right to continuously adjust its prices with effect for future purchases of surveys. All prices are excl. VAT.
3.2 Terms of payment
Payment is not due until the survey has been designed, approved and initiated (when all respondents have received an email invitation to participate in the survey). Payment terms is 14 days net from invoice date.
4. Limitation of liability
FACITanalysis cannot be held responsible for direct or indirect losses that have occurred in connection with the purchase and execution of surveys from FACITanalysis.
FACITanalysis’s liability for the Customer cannot exceed the invoiced amount of the survey product that the Customer has purchased from FACITanalysis. Neither the Customer nor FACITanalysis shall be held liable to the other party for matters beyond the control of the parties.
FACITanalysis is not responsible for the accuracy of information originated from a third source and presented by FACITanalysis.
5. Confidentiality
Data that the Customer has provided for FACITanalysis is never given to third parties (unless another agreement has been entered into in writing). However, contact and survey data are stored at ZOHO SURVEY as long as a survey is active and Google Sheets/Google Data Studio (Looker Studio) are used when designing results reports (as mentioned in 2.2. Data collection).
FACITanalysis deletes all survey data and contact data no later than 10 working days after the results report has been sent to the Customer (unless another agreement has been entered into in writing).
The knowledge that the parties gain about each other as a result of this cooperation must be treated with complete confidentiality.
6. Confidentiality
The parties and their employees are obliged to keep secret all information and acquired knowledge of the other party or other matters which the parties may become aware of in connection with the conclusion of the agreement. The parties’ duty of confidentiality is unlimited in time.
7. Choice of law and venue
The provisions of the agreement are governed by Danish law. Disputes must be settled by the Copenhagen City Court as the first instance.
